Builders Lien Act and Prompt Payment & Adjudication Legislation Prompt Payment Survey
On January 24, 2019, Adrian Breitwieser and Ryan Coles of CCI South attended stakeholder consultations regarding changes to the Builder’s Lien Act and new Prompt Payment and Adjudication Legislation. The topic will affect condominiums as condominiums are “owners” under the Builder’s Lien Act and must abide by construction legislation when completing any major projects.
Businesses in the construction sector have identified that they have been struggling due to payment delays. Contractors have identified that the timeliness of payment in the construction industry has become a significant problem. As a result, the government is considering changing the Act and Regulations to establish a better process to enforce timely payments, other than through the court system.
These changes have the potential to significantly impact condominiums and condominium service providers who complete construction work for condominiums. Changes to the legislation are expected to be potentially introduced in 2021. We urge our members to take the survey by the deadline of March 20, 2020.
